Ice Cream for a Better Planet Contest Official Rules

1. Eligibility: The Ice Cream for a Better Planet Contest (the “Contest”) is open only to those who are at least 18 years old as of the date of entry, and who complete the Contest requirements. The Contest is only open to legal residents of the United States and District of Columbia, and is void where prohibited by law. Employees of Bliss Unlimited LLC (“Bliss”), its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

2. Agreement to Rules: By participating, the Contestant (“You”) agree to have affirmatively reviewed, accepted, and agreed to all of the Rules, to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Bliss as final and binding as it relates to the content of this Contest.

3. Contest Period: Entries will be accepted online starting on July 15, 2022 11:00am EST and ending August 15, 2022, 11:59pm EST. All online entries must be received by August 15, 2022, 11:59pm EST.

4. How to Enter: The Contest must be entered by (1) following Bliss (@findcosmicbliss) on Instagram, Facebook, TikTok, or Twitter, (2) creating a video of yourself screaming, (3) posting it on either Instagram, Facebook, TikTok, or Twitter with the hashtag #icecreamforabetterplanet, and (4) tagging Bliss (@findcosmicbliss). Those that post a video with appropriate hashtag and tag will be automatically entered in the Contest. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Bliss.

Limit one entry per person. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Bliss.

5. Prizes: A total of three (3) prizes will be awarded. Two (2) winners (“The Winners”) will each receive a month’s supply (four (4) pints) of Cosmic Bliss ice cream. One (1) winner (“The Grand Prize Winner”) will receive the Grand Prize of a year’s supply (48 pints) of Cosmic Bliss ice cream. Total Prizes Approximate Retail Value (“ARV”): $1,290.00. Actual/appraised value may differ at time of prize award. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. The prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).  Restrictions, conditions, and limitations may apply. The specifics of the prize shall be solely determined by Bliss. No cash or other prize substitution shall be permitted except at Bliss’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner are permitted. Acceptance of prize constitutes permission for Bliss to use Winner’s names, likenesses, and video entries for purposes of advertising and trade without further compensation unless prohibited by law.

The Winners will receive their prize in the form of a one-time delivery of four (4) coupons valid for one (1) pint each. The Grand Prize Winner may choose to receive each month for twelve (12) months, starting September 2022 and ending August 2023, either (A) four (4) coupons valid for one (1) pint each, or (B) four (4) pints delivered via Instacart. Winner must be in the Instacart delivery range of a store carrying Cosmic Bliss products in order to select Option B. Winner will be able to select their four (4) flavors from either the plant-based line or the grass-fed dairy line each month. Prize does not include “novelties.” Flavor selection may vary and is based upon available supply.

6. Odds: The odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification: The Winners and The Grand Prize Winner will be selected on or around August 18, 2022. The Winners and the Grand Prize Winner will be selected by a panel of judges based on the following criteria: (1) creativity, (2) hilarity, and (3) overall best scream. The judges will name a Winner in each category based on the highest score in each category. A tie will be re-judged by the judges. The Winners and The Grand Prize Winner will be notified by direct message within three (3) days following selection, which will include a request for information needed to fulfill prize. Bliss shall have no liability for any Winners’ failure to receive notices due to spam, junk e-mail, or other security settings or for any Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winners and The Grand Prize Winner cannot be contacted, is ineligible, fails to claim the prize within 3 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by The Winners and The Grand Prize Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT BLISS‘S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Rights Granted by You: By entering this content (e.g., video and text, etc.), You understand and agree that Bliss, anyone acting on behalf of Bliss, and Bliss’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

9. Terms & Conditions: Bliss reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Bliss’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Bliss may select the Winners and The Grand Prize Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Bliss. Bliss shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Rules; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Contest or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the Winners or The Grand Prize Winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Bliss’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this Contest or any promotion or prize related activities. Bliss reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Rules. Bliss has the right, in its sole discretion, to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, Bliss reserves the right to seek damages to the fullest extent permitted by law.

10. Limitation of Liability: By entering, You agree to release and hold harmless Bliss and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error in the administration of the Contest or the processing of entries. If for any reason Your entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Your sole remedy is another entry in the Contest. No more than the stated number of each prize will be awarded.

11. Disputes: This Contest is governed by the laws of the State of New York without respect to conflict of law doctrines. As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.

12. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the Bliss website. To read the Privacy Policy, click here. By participating in the Contest, you grant Bliss permission to share your personally identifiable information with the other Bliss entities for the purpose of administration and prize fulfillment, including use in a publicly available Winner list.

13. Winners List: The Winners and The Grand Prize Winner will be posted here on or about August 25th.

14. Sponsor: The Sponsor of the Contest is Bliss PO Box 288, Eugene, OR 97440, United States. Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the Contest. Entrants should look solely to Sponsor with any questions, comments or problems related to the Contest. Bliss may be reached by email at customerservice@cosmicbliss.com during the Contest.

15. Social Media: The Contest hosted by Bliss is in no way sponsored, endorsed, administered by, or associated with Instagram, Facebook, TikTok, or Twitter.
